While the image includes a screenshot of a copyrighted game (Metroid Prime 3), it is believed its use in this photograph can be, taken as de minimus - it is a small resultion, "obscured in part by," the lighting and "blurring from the photographer." And the key focus of this image is how the player, "Wii Remote," Wii, sensor bar, and television are set up——to be able to play Wii games, rather than the gameplay of the game show.
